1. Introduction

Welcome to www.ssherbalindia.com (the "Website"). SHAGUNVEDA GLOBAL PVT. LTD. ("Company", "SS Herbal", "we", "us", "our") is the owner of the brand SS Herbal and the Website. The Company is incorporated under the Companies Act, 2013, bearing CIN U73100DL2025PTC448338, with its registered office at SNO 545, New Grain Market, New Grain Market Road, Karnal, Haryana – 132001, India.

These Terms of Use ("Terms") govern your access to and use of the Website, our mobile application (if any) and all related services (together, the "Platform") for browsing and purchasing our Ayurvedic, herbal and natural wellness products. These Terms must be read together with our Privacy Policy, Shipping & Delivery Policy and Cancellation, Refund & Return Policy (collectively, the "Policies"), each as updated from time to time.

By visiting, browsing, registering on, or making a purchase through the Platform — whether from a computer or a mobile device — you accept and agree to be bound by these Terms and the Policies, whether or not you have read them in full. The Platform is meant only for your personal, non-commercial use. If you do not agree with any part of these Terms or the Policies, we request you not to use the Platform.

We may add, remove, change or update any portion of these Terms and the Policies at any time, at our sole discretion, without prior written notice. Updated versions become effective as soon as they are published on the Website. It is your responsibility to review this page periodically, and your continued use of the Platform after any change will be treated as your acceptance of the revised Terms. As long as you comply with these Terms, we grant you a personal, limited, non-exclusive and non-transferable permission to access and use the Platform.

2. Eligibility

To use the Platform, you must be at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872. Persons who are incompetent to contract — including un-discharged insolvents — are not permitted to use the Platform. If you are a minor (below 18 years), you may browse the Website only under the supervision of a parent or legal guardian, and any purchase on your behalf must be made by them.

If you access or use the Platform on behalf of another person, you confirm that you have the authority to bind that person to these Terms and the Policies. If that person declines to be bound, you agree to bear full responsibility for any harm or loss caused by such use of the Platform.

3. Account Registration and Security

You may place an order by registering an account on the Website, checking out as a guest, or contacting our customer support team. If you create an account:

  • You must provide true, accurate, complete and current information, and keep your account details updated at all times so that we can communicate with you about your purchases.
  • You are solely responsible for maintaining the confidentiality of your username and password, for restricting access to your device, and for every activity that takes place under your account.
  • You must inform us immediately at support@ssherbalindia.com if you notice any unauthorised use of your account or any other breach of security.
  • If we detect or reasonably suspect a security breach or misuse of your account, we may ask you to reset your password, or temporarily or permanently suspend or block your account, without any liability on our part.

We also reserve the right to verify and validate the details you provide at any time. If any information is found to be false or misleading, in whole or in part, we may reject your registration and restrict you from using the Platform without prior notice. We further reserve the right to refuse service or terminate any account, without prior notice, if these Terms are violated or if we determine, in our sole discretion, that doing so is in the Company’s best interest.

4. Coupons, Discounts and Promotional Offers

From time to time, we may run discount coupons, festival sales, combo offers, cashback schemes or other promotional campaigns on the Platform. All such offers are subject to the following general conditions:

  • Every coupon or offer will have its own validity period, discount percentage, maximum discount cap, minimum order value and product applicability, which will be communicated at the time of the offer.
  • Unless expressly stated otherwise, only one coupon can be applied per order, and coupons cannot be clubbed with any other ongoing promotion, sale event, free-product offer or Buy-One-Get-One (BOGO) deal.
  • Coupons may not apply to certain products, categories, combos, cart fillers or non-discountable items, as decided by us.
  • Promotional coupons will not apply to orders that already include free or complimentary products.
  • Coupons hold no cash value, cannot be exchanged for cash, and cannot be carried forward once expired.
  • If an order placed using a coupon is cancelled or returned, the coupon benefit will stand lapsed and will not be re-issued unless we choose to do so.
  • We reserve the sole right to introduce, modify, cap, suspend or withdraw any coupon or offer at any time without prior notice. In case of misuse, fraudulent use or bulk abuse of coupons, we may cancel the concerned orders and block the associated accounts.

5. Products, Descriptions and Availability

We make every reasonable effort to describe our products accurately on the Platform. However, we do not warrant that product descriptions, images, colours, pricing or other content are always complete, current or free from errors. Product photographs are indicative only — the actual product may differ slightly in appearance, and the colours you see will also depend on your screen or device settings.

Since our products are made from naturally sourced herbal ingredients, their availability may vary with seasons and raw-material supply. For the same reason, minor batch-to-batch differences in colour, texture, aroma or taste — including natural sedimentation in juices — may occur; this is normal for natural products and does not affect their quality or efficacy.

We reserve the right to correct any errors, inaccuracies or omissions (including in pricing and availability), and to modify or discontinue any product, at any time without prior notice — even after an order has been placed. If we are unable to supply a product you have ordered, we will notify you by email/SMS, cancel the order, and refund the full amount paid, without any further liability on our part.

6. Pricing

All products on the Platform are sold at the price displayed at the time of ordering, which is inclusive of applicable taxes unless mentioned otherwise. Prices are subject to change at our discretion without prior notice; however, the price applicable to your order will be the price shown at the time you placed it — no extra amount will be charged or refunded if the price changes before delivery.

Please verify the total payable amount carefully at checkout. The final amount displayed at checkout is the complete amount payable — no additional charges will be collected at the time of delivery, except where you have chosen Cash on Delivery, in which case you must pay the full order amount to the delivery agent before accepting the package.

In case of an obvious pricing or typographical error, we reserve the right to cancel the order and refund any amount already paid.

7. Orders and Payments

The display of products on the Platform is an invitation to offer, not an offer to sell. When you place an order, you make an offer to purchase the product at the listed price; a binding contract comes into existence only when we accept the order and dispatch the product.

We may accept or reject any order at our discretion for reasons including — but not limited to — product unavailability, pricing or description errors, suspected fraud, or non-serviceable delivery locations, irrespective of whether the order was confirmed or payment was received. If we cancel your order, the entire amount paid will be refunded to you.

You may pay through the various options available on the Platform, including secure online payment gateways and Cash on Delivery (where eligible). You undertake to use only your own debit/credit card, UPI or banking details for transactions. We do not store your card number, CVV, UPI PIN or banking passwords; all online payments are processed through secure, encrypted payment gateways. Where all security checks have been duly completed through the secure server, we shall not be responsible for any misuse of your payment credentials, and the burden of proving fraudulent use of your card shall rest with you. Never share your card or banking credentials with anyone over email, chat or phone.

8. Health and Wellness Disclaimer

Our products are traditional Ayurvedic, herbal and natural wellness products. They are not intended to diagnose, treat, cure or prevent any disease, and nothing on the Platform constitutes medical advice. Any information, recommendation or suggestion provided on the Platform is for general informational purposes only and does not amount to an endorsement or a substitute for consultation with a qualified medical practitioner.

Individual results may vary. Before using any product, please read the label, ingredients and product description carefully to rule out ingredients you may be allergic or sensitive to, and consult a doctor if you are pregnant, nursing, on medication or have an existing medical condition. If you experience any adverse reaction, discontinue use immediately and seek medical advice. You agree that any reliance you place on the information provided on the Platform, and any use of our products, is at your own risk and responsibility.

9. Acceptable Use

While using the Platform, you agree that you will not:

  • use the Platform for any unlawful, fraudulent, harmful or commercial purpose;
  • resell, redistribute or commercially exploit our products without our prior written authorisation — products purchased from the Platform are for personal use only;
  • upload, post, share or transmit any content that is false, defamatory, obscene, abusive, hateful, infringing or otherwise unlawful;
  • attempt to gain unauthorised access to the Platform, its servers or connected systems, or use any device, software, bot or routine to interfere with its proper functioning;
  • introduce viruses, malware or any other harmful code;
  • copy, scrape, modify, distribute or misuse any content, trademarks or branding from the Platform; or
  • interfere with any other user’s access to or enjoyment of the Platform.

You remain solely responsible for all content that you upload, post, email or otherwise transmit through the Platform.

10. Intellectual Property and User Content

The "SS Herbal" name and logo, and all related product names, taglines, designs, text, graphics, images, videos, software and other material appearing on the Platform, are the intellectual property of SHAGUNVEDA GLOBAL PVT. LTD. or its licensors, and are protected under applicable laws. Access to the Platform does not grant you any right, title or interest in this intellectual property.

You may view and download content from the Platform only for your personal, non-commercial use. Copying, storing, modifying, distributing, republishing or otherwise using any part of the Platform or its content for commercial purposes, without our prior written permission, is strictly prohibited.

When you submit reviews, ratings, photos, videos or other content on the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display such content in connection with our business, and you confirm that your content is genuine, lawful and does not infringe any third party’s rights.

11. Cancellation, Refunds and Returns

You may cancel an order any time before it is dispatched by:

  • Going to My Account > Orders on the Website and cancelling the order yourself; or
  • Contacting our customer support team by phone, email or WhatsApp at the contact details given below.

If the cancellation option is no longer visible, it means your order has already been dispatched — in that case, please reach out to customer support for further assistance. Please note that complaints regarding an order will not be entertained beyond 7 days from the date of delivery.

We manage the logistics of delivering your order through our courier and delivery partners. An estimated delivery timeline will be shown at the time of placing the order based on your location, and a tracking number will be shared once the order is shipped. 13. Disclaimer of Warranties

The Platform and all products and services offered through it are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind — express or implied — regarding the operation of the Platform or the accuracy, completeness, reliability or suitability of the information, content, materials or products displayed on it. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Products are covered only by such warranties, if any, as are provided by their respective manufacturers or mentioned on the product packaging. We do not warrant that the Platform, its servers or emails sent by us are free from viruses or other harmful components. Your access to the Platform may also be interrupted by factors beyond our reasonable control, such as internet or telecom outages or scheduled maintenance.

14. Limitation of Liability

To the maximum extent permitted by applicable law, neither the Company nor its directors, employees, affiliates, partners or licensors shall be liable — whether in contract, tort (including negligence) or otherwise — for any indirect, incidental, special, punitive or consequential damages of any kind (including loss of profits, data or goodwill) arising out of or connected with your use of the Platform or our products, even if we were advised of the possibility of such damages.

Without limiting the above, we shall not be liable for: (a) business interruption; (b) delays or interruptions in accessing the Platform; (c) data loss, theft, corruption or mis-delivery; (d) losses arising from third-party links on the Platform; (e) viruses, system failures or malfunctions; (f) inaccuracies or omissions in content; or (g) events beyond our reasonable control. In any event, our total aggregate liability towards you shall not exceed the amount actually paid by you for the specific product or order giving rise to the claim.

We shall also not be liable for any damage arising from product misuse, abuse, modification, improper selection, or failure to follow usage directions. Any claim relating to the Platform or these Terms must be brought within one (1) year from the date the cause of action arose. If you are dissatisfied with the Platform, your sole remedy is to discontinue its use.

15. Indemnity

You agree to defend, indemnify and hold harmless the Company, its directors, officers, employees, agents, affiliates, partners, licensors, successors and assigns from and against all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to: your breach of these Terms or the Policies; your violation of any applicable law or third-party right (including intellectual property, privacy or publicity rights); any content submitted by you; or your misuse of the Platform. This obligation shall survive the termination of these Terms.

These Terms remain in effect until terminated by either you or us. You may terminate them at any time by permanently discontinuing your use of the Platform. We may terminate these Terms and deny you access to the Platform at any time, without notice and without liability, particularly in the event of any breach by you. Upon termination, you must destroy all material downloaded or obtained from the Platform along with all copies thereof. Termination will not relieve you of your obligation to pay for products already ordered, nor affect any liability that arose before termination.

17. Governing Law and Jurisdiction

These Terms and all disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. The competent courts at Karnal, Haryana shall have exclusive jurisdiction over all such disputes. We further reserve the right to seek injunctive or other equitable relief from any court of competent jurisdiction to protect our intellectual property or confidential information.

18. General Provisions

These Terms, together with the Policies, constitute the entire agreement between you and us regarding your use of the Platform and supersede all prior understandings and communications. Nothing in these Terms creates any agency, partnership, joint venture or employment relationship between you and the Company.

Our failure to enforce any provision of these Terms shall not be treated as a waiver of our right to enforce it later, nor shall a waiver of any breach operate as a waiver of the provision itself. If any provision of these Terms or the Policies is held invalid or unenforceable, the remaining provisions shall continue in full force, and the invalid provision shall be modified to the extent possible to reflect the original intent. Section headings are for convenience only and shall not affect interpretation.
